Guardianship allows a qualified adult to care for a child or incapacitated individual. Many situations can create a need for guardianship. Common scenarios include adult children caring for parents in failing health or family caring for children whose parents are struggling with addiction. In many guardianship cases, the court will appoint a guardian ad litem (sometimes called a “GAL”). This person represents the best interest of the person who will be placed under the guardianship. The guardian ad litem will investigate both the need for a guardianship and whether the proposed guardian is the most appropriate person to serve in that role.
